Terms of Service for Wake Up Call Service

Effective Date: February 8, 2025

These Terms of Service (“Terms”) govern your access to and use of the Wake Up Call Service mobile application (“the App”) provided by So Curious, LLC (“So Curious,” “we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the App.

1. Account Creation and Use

  • Eligibility: You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
  • Accurate Information: You agree to provide accurate and complete information when creating an account and to keep your account information updated.

2. User Conduct

  • Prohibited Activities: You agree not to use the App to:
    • Violate any applicable law or regulation.
    • Impersonate any person or entity.
    • Stalk, harass, or harm another individual.
    • Transmit any harmful or offensive content.
    • Interfere with or disrupt the App or servers.
    • Engage in any fraudulent or deceptive activity.

3. Call Features and Usage

  • Call Scheduling: The App allows you to schedule wake-up calls and other types of calls. You are responsible for ensuring that the call information you provide is accurate and that you have the necessary permissions to receive calls at the scheduled time.
  • Call Recordings: Some wake-up calls may be recorded for quality and training purposes. By using the App, you consent to the recording of your calls.
  • Call Limits: Free users have a limited number of calls. Premium users have a higher call limit and access to additional features.
  • Caller Availability: Callers are assigned to calls based on their availability. We do not guarantee that a caller will be available for every scheduled call.

4. Intellectual Property

  • App Ownership: The App and all intellectual property rights related to the App are owned by So Curious.
  • User Content: You retain ownership of any content you submit through the App. However, you grant So Curious a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with the App.

5. Disclaimer of Warranties

  • App Provided “As Is”: The App is provided “as is” without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • No Guarantee of Availability: We do not guarantee that the App will be available at all times or that it will be free from errors or interruptions.

6. Limitation of Liability

  • No Indirect Damages: In no event shall So Curious be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
  • Maximum Liability: So Curious’s total liability to you for any and all claims arising out of or related to your use of the App shall be limited to the amount you paid, if any, to access the App.

7. Indemnification

You agree to indemnify and hold So Curious harmless from any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to your use of the App or your breach of these Terms.

8. Termination

  • Termination by You: You may terminate your account at any time by contacting us at support@realwakeupcalls.com.
  • Termination by Us: We may terminate your account at any time for any reason, including but not limited to your breach of these Terms or our suspicion of fraudulent or abusive activity.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Redding, California.

10. Changes to These Terms

We may update these Terms from time to time. We will post any changes on our website and notify you as required by law.

11. Entire Agreement

These Terms constitute the entire agreement between you and So Curious with respect to the App and supersede all prior or contemporaneous communications and proposals, whether oral or written.
